TITLE I. GENERAL PROVISIONS
Chapter 1. Purpose and Relationship to the Full Privacy Notice
1.1 Purpose
This Cookie Policy (hereinafter, the "Policy") is intended to inform the Data Subject in detail about the use of cookies, web beacons and other similar tracking technologies within the website and application of Ancuria™ Inteligencia Inmobiliaria (hereinafter, "Ancuria" or the "Platform"), in compliance with Article 16, section II, of the Regulations of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, the "Law").
1.2 Relationship to the Full Privacy Notice
This Policy develops and details the provisions of Chapter 13 (Use of Cookies, Web Beacons and Tracking Technologies) of Ancuria's Full Privacy Notice, with which it must be interpreted jointly and inseparably. In case of discrepancy between the two documents on this specific subject matter, the provisions of this Policy shall prevail, as it is the instrument specialized in the subject matter.
1.3 Data Controller
James Marcus Patman, with domicile at Calle Aldama 470, Sin Número Interior, Colonia El Cerro, Puerto Vallarta, Jalisco, C.P. 48304, Mexico, is the data controller of the cookies and technologies described in this Policy.
1.4 Consequences of non-compliance
Failure to make this Policy available, prior to deploying non-essential cookies on the Data Subject's device, shall constitute a breach of the information principle provided in the Law and its Regulations.
Chapter 2. Definitions
2.1 "Cookie"
A small data file that is downloaded and stored on the Data Subject's device (computer, mobile phone, tablet) when browsing the website or using the Ancuria application, allowing that device to be recognized on subsequent visits or sessions.
2.2 "Web beacon" or "tracking pixel"
An image or code fragment, generally invisible to the Data Subject, inserted into an internet page, application or email, used to monitor the behavior of the visitor or recipient.
2.3 "First-party cookie"
One installed and controlled directly by Ancuria.
2.4 "Third-party cookie"
One installed by a provider other than Ancuria, when that provider renders a service integrated into the Platform (for example, analytics or messaging tools).
2.5 "Session cookie"
One that is automatically deleted when the browser or application is closed.
2.6 "Persistent cookie"
One that remains stored on the Data Subject's device for a determined period, or until manually deleted by them.
2.7 "Data Subject"
The individual who browses the website or uses the Ancuria application, as defined in the Full Privacy Notice.
Chapter 3. Scope of Application
3.1 Scope
This Policy applies to all cookies and similar technologies deployed on Ancuria's public website, the Platform's administration panel, and the mobile application, when the latter uses analogous device-identification technologies.
3.2 Data Subjects covered
This Policy applies both to registered Users and to unregistered visitors of the Ancuria website.
TITLE II. CATEGORIES OF COOKIES USED
Chapter 4. Strictly Necessary Cookies
4.1 Function
These cookies are indispensable for the basic operation of the website and the Platform, allowing, among other functions, keeping the User's session active, remembering the elements of a form being filled out, and guaranteeing browsing security.
4.2 Consent regime
Under recognized practice in data protection matters, these cookies do not require the Data Subject's prior consent, since disabling them would prevent the provision of the requested Service; they are nonetheless informed in the table of Chapter 8 in compliance with the principle of transparency.
Chapter 5. Preference Cookies
5.1 Function
These cookies allow remembering the settings and preferences chosen by the Data Subject during browsing, such as the language, the geographic zone of property searches, or the Platform panel's display configuration.
5.2 Consent regime
The use of these cookies requires the Data Subject's tacit consent, deemed granted pursuant to the mechanism described in Chapter 9, unless stated otherwise.
Chapter 6. Analytics or Performance Cookies
6.1 Function
These cookies allow Ancuria to learn aggregate browsing patterns, such as the most visited sections, dwell time, and interaction flows within the site and the Platform, for the purpose of improving the user experience and prioritizing the development of new features.
6.2 Consent regime
The use of these cookies requires the Data Subject's consent pursuant to the mechanism described in Chapter 9.
Chapter 7. Marketing and Advertising Cookies
7.1 Function
When such functionality is enabled, these cookies allow showing the Data Subject relevant advertising about the Platform on third-party sites, as well as measuring the effectiveness of Ancuria's marketing campaigns.
7.2 Consent regime
The use of these cookies requires the Data Subject's express consent, which may be withdrawn at any time through the settings panel described in Chapter 10, without affecting the provision of the Service.
TITLE III. COOKIE INVENTORY
Chapter 8. Table of Cookies Used
8.1 Objective
In compliance with the duty of specificity, the inventory of cookies used on the website and the Platform is detailed below. This inventory must be kept up to date as Ancuria's technology infrastructure evolves.
| Cookie name | Type | Purpose | Duration | First-party / Third-party |
|---|---|---|---|---|
| mls_session | Strictly necessary | Authentication session cookie (signed JWT) that identifies the connected User, including their role and agency context. It is created upon login or registration, and keeps the session active, protecting access to the Platform's private pages. | Persistent, 7 days (also deleted server-side upon logout, before its natural expiration) | First-party |
| NEXT_LOCALE | Preferences | Remembering the Data Subject's language preference (Spanish or English) on the website. It is only created if the Data Subject uses the language selector. | Persistent, 365 days | First-party |
| Not applicable | Analytics | Ancuria does not use analytics cookies. This category is documented for information purposes pursuant to Title II; no cookie of this type is currently deployed on the website or the Platform. | Not applicable | Not applicable |
| Not applicable | Marketing | Ancuria does not use marketing or advertising cookies. This category is documented for information purposes pursuant to Title II; no cookie of this type is currently deployed on the website or the Platform. | Not applicable | Not applicable |
8.2 Updating the inventory
The Data Controller will update the table above as new providers or tracking technologies are incorporated, without such update, by itself, constituting a material amendment of this Policy, unless it involves the incorporation of a new category of cookies not contemplated in Title II.
8.3 Consequences of non-compliance
The use of a cookie not informed in the inventory of this Chapter shall constitute a breach of the information principle provided in the Law.
8.4 Third-party cookies and other technologies
On the browser side, Ancuria only communicates with Google Fonts for the loading of typefaces; that provider does not install cookies nor receive personal data of the Data Subject derived from such use. Except for the foregoing, Ancuria does not use third-party cookies, traffic analytics tools, or advertising or marketing technologies within the website or the Platform.
8.5 Technical attributes of first-party cookies
The mls_session cookie has the HttpOnly, Secure, SameSite=Lax and path=/ attributes. The NEXT_LOCALE cookie has the SameSite=Lax and path=/ attributes. Both cookies are technically persistent under the definition of section 2.6, as there are no session cookies on the Platform in the strict sense of section 2.5; nevertheless, the mls_session cookie is deleted server-side when the User logs out, regardless of its scheduled expiration date.
8.6 Related local storage
In addition to the use of cookies, the website stores in the Data Subject's browser localStorage, under the key “rentamls-cookie-consent”, the choice made by them in the consent banner described in Chapter 9. Unlike a cookie, localStorage content is not automatically transmitted to the server with each request; its sole purpose is to remember the Data Subject's preference in their own browser.
8.7 Anonymous or private browsing
Browsing in the browser's private or incognito mode does not generate any of the cookies described in this Chapter, since those modes prevent, by design, the persistent storage of data on the Data Subject's device.
TITLE IV. LEGAL BASIS, CONSENT AND TRANSFERS
Chapter 9. Consent Mechanism
9.1 Cookie banner
Upon first entering the Ancuria website, the Data Subject will see an informative banner allowing them to: (i) accept the use of all cookie categories; (ii) reject non-essential cookies; or (iii) access the detailed per-category settings described in Chapter 10.
9.2 Tacit consent through continued browsing
Under recognized practices in the field, and without prejudice to the banner indicated in the preceding section, continued browsing on the site without having expressly configured cookie preferences may be understood, with respect to preference and analytics cookies, as tacit consent, but not with respect to marketing cookies, which require the Data Subject's express affirmative action pursuant to section 7.2.
9.3 Consequences of non-compliance
Deploying marketing cookies without the Data Subject's express affirmative action shall constitute a breach of this Policy and of the Law.
Chapter 10. Cookie Management and Settings
10.1 Own settings panel
The Data Subject may modify their cookie preferences at any time through the privacy settings panel available on the Ancuria website, normally accessible from the site's footer.
10.2 Configuration through the browser
Independently of the panel indicated in the preceding section, the Data Subject may manage or delete cookies directly from their browser's settings, according to the following general instructions:
10.3 Google Chrome
Settings > Privacy and security > Cookies and other site data.
10.4 Mozilla Firefox
Options > Privacy & Security > Cookies and Site Data.
10.5 Safari
Preferences > Privacy > Manage Website Data.
10.6 Microsoft Edge
Settings > Cookies and site permissions > Manage and delete cookies.
10.7 Effects of disabling
The Data Subject acknowledges that disabling strictly necessary cookies will prevent the correct operation of the site and the Platform, and that disabling other categories may limit certain features or personalizations, without preventing access to the contracted Service.
10.8 Consequences of non-compliance
The lack of effective availability of the settings panel indicated in section 10.1 shall constitute a breach of the duty to facilitate the exercise of rights provided in the Law.
Chapter 11. International Transfers Deriving from the Use of Cookies
11.1 Third-party providers
Certain third-party cookies indicated in the inventory of Chapter 8 may be operated by providers with infrastructure located outside the United Mexican States, in which case the provisions of Chapter 12 (International Transfers) of the Full Privacy Notice shall apply.
11.2 Consequences of non-compliance
The use of cookies from third parties located abroad without observing the protection measures referred to in the preceding section shall constitute a breach of the responsibility principle provided in the Law.
TITLE V. VALIDITY AND FINAL PROVISIONS
Chapter 12. Validity and Amendments
12.1 Entry into force
This Policy shall enter into force on the date stated on the cover page of this document.
12.2 Modifications
The Data Controller may modify this Policy at any time, particularly to reflect changes in the cookie inventory of Chapter 8, publishing the updated version on the website and indicating its last-update date, pursuant to the mechanism provided in the Full Privacy Notice.
12.3 Governing language
In the event of translation into another language, the Spanish (Mexico) version shall prevail for interpretation purposes in case of discrepancy.
